CROWN HEIGHTS, NY - CHK IS PUT IN QUESTION AS MARA D’ASRA RABBI A OSDOBA AND SON ARE PLACED IN SIRUV

A private divorce case has turned into a public matter when Levi Osdoba refused give his wife a get. The couple was unable to settle custododial and financial matters. They finally agreed to go to a Zablo, each side chose a Rov, made a kinyan and went on with the Din Torah.

When Levi Osdoba began to realize that the ruling would not be in his favor, he pulled out of the Din Torah. Rabbi Avraham Osdoba who is the Mara Dasra of the Crown Heights and in charge of the Hashgacha for CHK (Crown Heights Kashrus), permitted his son Levi to take this matter to the civil courts.

The Beit Din implored both father and son to return the matter to the Din Torah that they previously chose and made a Kinyan to follow.

The Beit Din was subsequently forced to take action and placed a Nideoy on both Rabbi Avraham Osdoba and his son Levi.

The esteemed Beit Din of America states in their Siruv and Nideoy against Horav Osdoba (and his son), that they are now completely disqualified in any capacity as a Rav or Eidus or for any Hechsher/Hashgoches (i.e. the "CHK").

The 3 Rabbonim of the Zabla, who issued the Nideoy are: Horav Arye Mordechai Rabinovitch (Mitzad Horav Osdobo) - Horav Shmuel Freid (Mitzad SH) - Horav Shlomo Ben Tziyon Herbst (the Sholish).

Rabbi A Osdoba in desperate search for a rav to support him against the Beis Din that issued the siruv,
some relief he found a good freind in Heifa Israel that did not ask questions did not contact the Bais Din did not review the cout documents but gave him a motional letter.

Let it be known that Levi Osdba's wife is an "eishes ish" caught red handed and any Bais Din taking her side is suspect.

perel osdoba has been diagnosed by medical experts with bi-polar and had to be hospitalised on several ocassions. it actually seems to run in the horowitz family - with her sister having had a break down and her mother too.
levi wanted to give her a get years ago and they refused.

Just to let you know that the Rav from Haifa who wrote the letter Retracted his letter and wrote two letters apologizing profusly since he has been horribly mislead by the Osdobas.

levi osdoba wanted to give a get years ago, but the horowitz family refused and asked for ONE MILLION dollars.

mrs. perel osdoba is sick, and if this does go to court, medical records will prove it, which led her father mr. sholom horowitz to use desperate measures (and to even unite with his enemies) to stop it from going to court and having to release his family's medical history.

rabbi A osdoba was never called to a bes din, so he cannot be placed in a siruv.

the only reason this happened is becauase the Igud harrabonim got involved and arranged levi a heter meah rabbonim.

Assuming that all you said is true, does this make the story false? You don't seem to contradict any of the statements in the story.

As I read the story (here and in other places) he was not ruled a Siruv, but put in Nidoy. A Beis Din can do that to anybody, can't they? Whether or not they *should* do it is another story altogether.

who made these rabbnim "bes din tzedek of america"???

who appointed them rabbonim of the entire america?

if they are a zabla, then they are not even a bes din with a name & a headed paper! they should be 3 independent rabbonim!

Everyone knows that the Beth Din of America is the Beth Din of the Rabbinical Council of America (http://www.bethdin.org). That is not who issued this letter. They are using another BD's name to mislead people; is that honest? And what power do they claim to prevent others from giving a heter meah rabbonim? If 100 rabbonim from three countries agree that he should be able to marry again, they can give him permission, and they don't need the approval of this or any other beis din.

I don't know the details of whether Osdoba really agreed to go to this beis din, and if so whether he had a good reason to withdraw his consent. Maybe he saw that the borerim he trusted were bribed or showing a bias against him - would anyone continue with a din torah under such circumstances? I don't know and neither does any of us. But I do know that it's a chazoko on R Osdoba that he wouldn't do something against the Torah, whereas these people I've never heard of and don't know what sort of chazoko they have.

כשחקרתי על "מהות" בית דין זה, התברר לי שהוא בית דין פרטי לבוררות, ושהשם "בד"צ ארצות הברית", אינו אלא שם "מסחרי".

ולכן, מהיותו בית דין פרטי לבוררות אין לו כל סמכות, הלכתית או משפטית, לדון בעניני גירושין או משמורת ילדים בית דין שכזה שהוא בא כח הצדדים סמכותו מוגבלת רק לדון בסכסוכים בעניני ממונות, שהם ענינים הנתונים להסכם שבין הצדדים למחילה וויתור, כך הוא בהלכה, (ראו פנקס המדינה או פנקס וועד הקהילות הראשיות במדינת ליטא, קובץ תקנות ופסקים משנת שפ"ג עד שנת תקכ"א תקנה תר"ט, (שמעון דובונוב ברלין תרפ"ה), וכך הוא במשפט הפוזיטיבי בישראל, ואולי כך הוא אף בארצות הברית

בית דין שכזה, שסמכותו היא מקבלת הקנין, ו/או מהסכם הבוררות שנחתם ע"י הצדדים, מוגבל בתנאי ההסכם, ואף שהצדדים חייבים לקיים את אשר הסכימו, אין לבית הדין כל סמכות להוציא כתבי סרוב על אי הופעה בבית הדין, או חרמים ונידויים על הליכה לערכאות.

דיינים-בוררים אלו טענו בכתב הסירוב, שהנידוי והחרם היו לאחר ששוחחו עם "גדולי ישראל", ואינם כותבים מי הם גדולי תורה אלו, ואין לי אלא לומר שלאחר שהם החליטו שהם עצמם גדולי ישראל, הם דיברו עם עצמם
וקבלו את הסכמתם.

אין לי ספק שאילו היה הרב אוזדובה כ"כל האדם", והיה פונה לבית המשפט בתביעת נזיקין על הוצאת דיבה נגדו על ידי בית הדין המוקיוני, היה שגעון הגדלות
של בית הדין מצטמק כהרף עין לגודל "עדשה".

So if these rumors are true, what about the many couples that the Rav has been Mesader Kedushin with over the past month? Are their marriages valid?

THIS SHOULD BE RESOLVED IMMEDIATELY AS COUPLES RECENTLY MARRIED BY THE ROV ARE IN QUESTION!!!

Why hasn't the Beis Din of CH reached out to these couples to inform them of their status? Where is the accountability here?
